Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Crackerjack website, mobile application, and booking platform (together, the "Platform"), operated by Crackerjack IT Solutions Private Limited ("Crackerjack", "we", "us"). By creating an account or otherwise using the Platform, you agree to these Terms.
Review notice: These Terms have not yet been reviewed by qualified counsel. They should be, before they are relied on in production.
1. What Crackerjack is
Crackerjack is a booking marketplace connecting artists — DJs, musicians, dancers, magicians, emcees, photographers, models, drone specialists, and other performers — ("Artists") with event organizers, venues, agencies, and managers ("Organizers"). Crackerjack is not a party to the booking agreement formed between an Artist and an Organizer; we provide the infrastructure — discovery, messaging, contracts, and protected payments — that lets both sides transact directly and transparently.
2. Eligibility & accounts
- You must be at least 18 years old to create an account and enter into bookings, and you confirm this when you sign up. Profiles for Artists under 18 are not supported, including profiles run by a parent, guardian or agency, and an account found to belong to a minor will be closed.
- You must provide accurate information and keep your profile up to date, including accurate rates, availability, and category of work.
- You are responsible for all activity under your account and for keeping your login credentials secure.
- We may suspend or terminate accounts that violate these Terms or our Trust & Safety standards.
3. Bookings
- Organizers send booking requests or offers to Artists through the Platform, specifying event details, date, venue, and rate.
- A booking becomes binding once both parties confirm it through the Platform's contract flow. Crackerjack provides standard contract templates, but the resulting agreement is between the Artist and the Organizer.
- Cancellation terms and refund eligibility are set out in our Refund Policy, shown to whoever is cancelling before they confirm, and are binding on both parties.
- Crackerjack may assist with dispute resolution per our Trust & Safety policy but does not guarantee the outcome of, or performance under, any booking.
4. Fees & commission (how Crackerjack makes money)
Creating a profile and using core discovery, calendar, and inbox features is free. Crackerjack earns a commission only on money actually released to an Artist:10% of the booking amount, 5% when the Artist stepped in as a replacement, and 7% for an Artist on Crackerjack Pro (Section 5A). The rate that applies is fixed when the booking is paid, shown to both sides before a booking is confirmed, and deducted automatically at payout. No commission is taken on money refunded to an Organizer, and we do not charge a listing fee. Additional revenue streams (e.g. optional premium placement, event-ticketing integrations, or advertising) will always be clearly labeled as such and are never a condition of joining the Platform.
5. Payments & how we hold funds
- Funds from an Organizer are collected through our payment processor and held by Crackerjack from the point a booking is confirmed. They are received into a Crackerjack-controlled account and recorded against the booking. They are not held by an independent third-party escrow agent, and we do not describe this as escrow.
- Held funds are released to the Artist's Crackerjack balance, less Crackerjack's commission, once the Artist marks the set complete and the Organizer confirms it — 12 hours after the scheduled end of the set, or 5 minutes after it for an Artist on Crackerjack Pro. The Artist may then cash that balance out to a saved payment method: a standard cash-out is free and sent within 24 hours; an instant cash-out arrives in minutes for a ₹149 fee taken from the balance. The smallest cash-out is ₹100, and UPI cash-outs are capped at ₹50,000 per transaction. If a booking is cancelled or disputed instead, see our Refund Policy for how funds are split.
- Payment processing is handled by third-party, PCI-DSS compliant processors; Crackerjack does not store full card or bank account numbers.
- Taxes on amounts earned through the Platform are the responsibility of the Artist or Organizer as applicable under local law. Where the law requires Crackerjack to withhold tax at source from an Artist's payout, we do: currently 0.1% of each cash-out is withheld as TDS when no GST number is on file, and the amount is shown before you confirm the cash-out.
5A. Paid subscriptions
Some optional features are sold as subscriptions: the in-app assistant at₹199 a month, and Crackerjack Pro for Artists, sold as a 3-month (₹899), 6-month (₹1,499) or 12-month (₹2,199) plan. Pro lowers commission to 7% and releases booking payments 5 minutes after the set instead of 12 hours. The price is shown before you subscribe and is charged through our payment processor at the start of each billing period — every month for the assistant, and every 3, 6 or 12 months for Pro, according to the plan you chose — until you cancel.
- Cancel any time. You can cancel from your account settings at any point, without contacting us and without giving a reason. Cancellation stops the next renewal; it does not shorten the period you have already paid for, and you keep access until the end of that period.
- Renewal. The subscription renews automatically at the end of each billing period, at the same price and for the same length, unless you cancel first. If we ever change the price, we will tell you before the change takes effect and you can cancel rather than accept it.
- If a renewal payment for the assistant fails, we will retry and let you know. You have 3 days from the first failed attempt to pay. If it is still unpaid after that, the subscription cancels automatically and the paid features simply switch off — we do not pursue you for the unpaid month, and no debt is created.
- If a Pro renewal payment fails, Pro ends. Bookings already paid keep the commission rate and release timing fixed when they were paid; bookings paid after that use the standard rates.
- Refunds. Subscription payments are not refunded automatically. You may request a refund by writing to us with your reason; we review each request individually and will refund where the reason is genuine — for example a charge you did not authorise, a duplicate charge, or a period in which the feature did not work. Contact details are in Section 14.
- Cancelling a subscription does not affect bookings, held funds, or payouts, which are governed by Sections 5 and by our Refund Policy.
"Cancel any time" means exactly what this section says, and is subject to these terms.
5B. Referral and creator rewards
These programmes pay real value, so their rules are set out here. We may change or end either programme; rewards already earned are not taken away, except under the fraud rule below.
- Referrals. When someone you referred completes their first booking on the Platform, you receive ₹200. After that, you receive 10% of the commission Crackerjack earns on each booking they complete as an Artist — about 1% of the booking amount. Referral earnings are added to your Crackerjack balance.
- Creator rewards. Artists can earn credits by posting about Crackerjack on Instagram under an active campaign. Each campaign sets its own rate per 1,000 views, a minimum number of views, a maximum number of paid views, a viewing window and a total budget, all shown before you post. You submit the post and a screenshot of its view count; the screenshot is read automatically and a person verifies the count before any credits are awarded. Once a campaign's budget is used up, it stops awarding credits.
- Redeeming credits. Credits can be redeemed only for the rewards listed on the Redeem tab, at the credit cost shown there. They cannot be transferred to another account.
- Fraud. Self-referrals, duplicate accounts, bookings arranged to generate a reward, and inflated or edited view counts are not eligible. Rewards obtained that way may be withheld or reversed, and the account may be suspended under Section 6A.
- Tax. Referral cash and creator rewards may be taxable as income if your total rewards from all sources exceed ₹50,000 in a financial year. We do not deduct TDS on rewards. You are responsible for reporting this income in your tax return if applicable. Tax withheld on a cash-out under Section 5 still applies when you cash out a balance that includes rewards.
6. Content & conduct
- You retain ownership of the portfolio media, bios, and other content you upload, and grant Crackerjack a license to display it on the Platform for the purpose of discovery and booking.
- You may not post content that is unlawful, infringing, misleading (including misrepresenting your identity, category, or credentials), or that violates the rights of others.
- You may not use the Platform to circumvent Crackerjack's commission by arranging payment for a Platform-sourced booking outside the Platform.
- Harassment, discrimination, or unsafe conduct toward Artists, Organizers, or Crackerjack staff will result in account action per our Trust & Safety policy.
6A. Message screening, strikes and suspension
Messages and images sent through the Platform are automatically screened for attempts to take a Platform-sourced booking off-platform — see Section 3A of our Privacy Policy for how that screening works and who processes it.
A message containing an unambiguous contact identifier (a phone number, email address, or messaging handle) may be rejected and a strike recorded against your account. Accumulated strikes may lead to temporary or permanent suspension. Weaker signals, such as an external link, produce a reminder only and do not count as a strike.
Your right to contest. If a message was wrongly blocked, or a strike or suspension wrongly applied, you may contest it by writing to our Grievance Officer (Section 14). A person — not an automated system — will review it. We acknowledge within 24 hours and aim to resolve within 15 days. Where an account is suspended, we will tell you the reason and what you can do about it, and funds already owed to you for completed bookings remain payable.
7. Prohibited use of artist location information
Where the Platform shows you an artist's location — an approximate area, a distance figure, or, for a confirmed booking where the artist has opted in, an exact location — that information is provided solely for legitimate booking, event-planning, and Platform-related purposes. See our Privacy Policy for exactly how this information is reduced in precision before it reaches you.
You must not:
- attempt to obtain an artist's precise or private location beyond what the Platform deliberately shows you;
- track an artist before, during, or after a booking;
- use location information to identify an artist's home, hotel, accommodation, workplace, or other private location;
- share, publish, sell, or redistribute an artist's location information;
- use location information to harass, threaten, stalk, intimidate, or contact an artist outside permitted Platform communication channels;
- attempt to bypass Crackerjack's technical controls or privacy protections (for example, by scripting repeated requests to back-solve an approximate distance into a precise position) to obtain more precise location information than the Platform intends to show you; or
- use information obtained through Crackerjack to facilitate any unlawful or harmful activity.
We may restrict, suspend, or terminate accounts that violate this section — see Trust & Safety for how reports are handled — and may preserve or disclose relevant information where required by law or necessary to protect users, artists, or the Platform.
8. Intellectual property
The Crackerjack name, logo, and Platform software are owned by Crackerjack and may not be used without written permission. Nothing in these Terms transfers any Crackerjack intellectual property to you.
9. Disclaimers
The Platform is provided "as is." Crackerjack does not guarantee that any Artist will be booked, that any Organizer's event will proceed as planned, or that any user's representations about themselves are accurate, though we take reasonable steps (verification, reviews, and dispute handling) to support trust between users.
10. Limitation of liability
To the maximum extent permitted by law, Crackerjack's aggregate liability arising from your use of the Platform is limited to the greater of (a) the commission fees paid by or attributable to you in the twelve months preceding the claim, and (b) the amount you paid through the Platform for the booking or ticket the claim relates to. Nothing in these Terms limits any liability that cannot be limited under applicable law, including under the Consumer Protection Act, 2019. Crackerjack is not liable for indirect, incidental, or consequential damages, or for the conduct or non-performance of another user under a booking.
11. Termination
You may close your account at any time. We may suspend or terminate access for violation of these Terms, fraudulent activity, or as required by law. Bookings already confirmed and paid for at the time of termination will be settled according to their agreed terms.
12. Governing law & disputes
These Terms are governed by the laws of India, without regard to conflict-of-law principles. Any dispute arising out of these Terms or the Platform will be subject to the exclusive jurisdiction of the courts of New Delhi, save for disputes between an Artist and an Organizer arising from a specific booking, which are handled per our Trust & Safety dispute-resolution process in the first instance.
13. Changes to these Terms
We may update these Terms from time to time. Material changes will be notified via the Platform or email at least 15 days before taking effect. Continued use of the Platform after that date constitutes acceptance of the updated Terms.
